Terms of Service

1. Acceptance of Terms

By downloading, installing, or using TalksyAI ("App", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent to use the App.

3. Description of Service

TalksyAI is an AI-powered small talk coaching application that helps users improve their conversational skills through:

• Interactive practice sessions with AI conversation partners
• Voice-based conversation simulations
• Real-time feedback on conversation techniques
• Progress tracking and personalized improvement plans
• Scenario-based practice for common social situations

4. Account Registration and Security

To access certain features, you must create an account using Google or Apple authentication. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and current

5. Subscription and Payments

5.1 Free Trial

New users receive a 7-day free trial period. You will not be charged during the trial period. The subscription will automatically begin at the end of the trial unless cancelled.

5.2 Subscription Plans

• Basic Monthly Plan: $9.99 per month
• Pro Monthly Plan: $19.99 per month

5.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your payment method will be charged the applicable subscription fee.

5.4 Cancellation

You can cancel your subscription at any time through your device's App Store or Google Play settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

5.5 Payment Processing

All payments are processed through Apple App Store, Google Play Store, or our third-party payment processor. Payment terms are subject to the respective platform's terms and conditions.

6. User Content and Voice Data

6.1 Your Practice Sessions

When you engage in practice conversations:

• Your voice inputs are processed directly by OpenAI's Realtime API
• Real-time voice conversations are handled by OpenAI (not stored by us)
• Conversation transcripts are sent to our backend for analysis and feedback
• Session transcripts are stored for your review and progress tracking
• You retain ownership of your conversation content

6.2 License to Use

By using the App, you grant us a limited, non-exclusive license to process your conversation transcripts (text data only) for the purpose of providing analysis, feedback, and improving the Service. Voice data is processed directly by OpenAI under their terms of service.

6.3 Content Restrictions

You agree not to use the App to practice or simulate conversations that:

• Contain harassment, hate speech, or discriminatory content
• Include threats, violence, or illegal activities
• Contain sexually explicit or inappropriate content
• Violate the privacy or rights of others
• Attempt to manipulate or deceive others

7. AI Limitations and Disclaimers

You acknowledge and agree that:

• AI feedback is not a substitute for professional communication coaching or therapy
• The App is not intended to treat social anxiety or other mental health conditions
• AI responses may not always be accurate or appropriate
• Success in practice sessions does not guarantee real-world outcomes
• We do not provide medical, psychological, or professional advice

8. Privacy and Data Protection

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• Voice data is processed directly by OpenAI's Realtime API and not stored by us
• Only text transcripts are processed and stored by our backend
• Transcripts and analytics are stored securely in our database
• You can request deletion of your data at any time
• We do not sell your personal data to third parties

9. Intellectual Property Rights

9.1 Our Property

The App, including its design, features, content, and technology (excluding user content), is owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Use our trademarks without permission
• Scrape or extract data from the App

9.2 Feedback

Any suggestions or feedback you provide about the App becomes our property and may be used without compensation to you.

10. Disclaimers and Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.

12. Governing Law and Disputes

These Terms are governed by the laws of Vietnam without regard to conflict of law principles. Any disputes shall be resolved in the courts of Vietnam.
